Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FeeSend application and website (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Who may use the Service

You must be at least 18 years old and capable of entering into a binding contract. If you use the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

2. Your account

• You are responsible for maintaining the security of your login credentials.
• You must provide accurate and complete information.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorised use of your account.

3. Acceptable use

You agree not to:

• Send messaging to individuals who have not consented to receive it, or violate WhatsApp/Meta policies.
• Use the Service for spam, harassment, fraud or any unlawful purpose.
• Upload viruses or attempt to gain unauthorised access to the Service.
• Reverse engineer, resell or copy the Service without permission.
• Misrepresent your identity or impersonate any person or entity.

4. Fees, plans and credits

• Paid plans are billed monthly or yearly in advance, based on the plan you select.
• Messaging is metered in credits. Credits included in a plan reset each billing period and do not carry over unless stated otherwise.
• Top-up credit packs are non-refundable once consumed.
• We may change prices with reasonable notice; changes apply from your next billing period.

5. WhatsApp Business Platform and Meta compliance

The Service enables you to send and receive messages through the official WhatsApp Business Platform (the "WhatsApp Business Cloud API") provided by Meta. By using the Service you also agree to comply with Meta's applicable terms and policies, including the WhatsApp Business Terms, the WhatsApp Business Messaging Policy, and the Meta Platform Terms.

• You must have a valid WhatsApp Business Account and a lawful basis, including any required consent, to contact each phone number you message.
• You must not send unsolicited or spam messages, must respect recipient opt-outs, and must use only approved message templates and the correct template category.
• You are responsible for the content of the messages you send and for your customers' data that you upload.
• We are not Meta and are not endorsed or sponsored by Meta. Meta may charge WhatsApp conversation or per-message fees to your WhatsApp Business Account separately; those charges are between you and Meta. Fees you pay to FeeSend are for the FeeSend Platform only.
• We may suspend or terminate access if your use risks a violation of Meta's policies or the integrity of the WhatsApp Business Platform.

6. Third-party services

The Service uses third-party providers, including Meta's WhatsApp Business Cloud API and payment gateways. Your use of those services may be subject to their own terms. We are not responsible for the acts or omissions of third-party providers.

7. Your data

You retain ownership of the data you upload. You grant us a licence to process that data solely to provide the Service. Our handling of personal data is described in our Privacy Policy, and your ability to request deletion is described in our Data Deletion Instructions.

8. Intellectual property

The Service, including its software, design, logos and content, is owned by FeeSend and its licensors and is protected by applicable laws. These Terms do not grant you any right to use our trademarks without consent.

9. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend or discontinue features with reasonable notice where practicable.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free or that messages will always be delivered by third-party networks.

11. Limitation of liability

To the maximum extent permitted by law, FeeSend shall not be liable for any indirect, incidental or consequential damages, or for any loss of profits, data or goodwill. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or applicable law. On termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
